AmiVital Terms of Service

1. Introduction
These Terms of Service govern all access to and use of AmiVital services, including coaching services,
digital products, wellness programs, future supplements, communication platforms, and any related
offerings. By accessing or purchasing any AmiVital product or service, you agree to be bound by these
Terms. If you do not agree, do not use AmiVital services.

3. Eligibility
You must be at least eighteen years of age and legally capable of entering into a binding agreement.
You must provide accurate information during sign up or intake processes and update it when
necessary. AmiVital services are intended for personal, non commercial use.
4. Nature of Services
AmiVital provides wellness coaching, behavioral guidance, fitness support, and educational health
content. These services are not medical services and do not replace professional medical care.
AmiVital does not diagnose, treat, cure, or prevent disease. Clients must consult their physicians before
making any changes to diet, exercise, supplements, or medication.
5. Digital Products
Digital products include ebooks, guides, video programs, templates, and downloadable resources.
These products are delivered immediately after purchase. Due to their nature, digital products are non
refundable once accessed or downloaded. You receive a personal, non transferable license for private
use only. Redistribution or publication of any digital product is prohibited.
6. Coaching Services
Coaching services may include one on one sessions, group sessions, fitness guidance, nutrition
guidance, habit formation strategies, mindset coaching, and lifestyle support. Coaching is not therapy,
counseling, or medical guidance. Clients acknowledge that implementing changes based on coaching
input involves inherent risks and personal responsibility. Late cancellations or missed sessions are
forfeited. Coaching begins immediately unless otherwise agreed.
7. Program Structure
AmiVital coaching is structured in four week periods. Clients may continue for multiple periods. Future
programs may include longer commitments such as a six month course. Program content, check ins,
and communication expectations will be provided to clients during onboarding.
8. Communication
Clients may communicate with AmiVital through email, WhatsApp, and Trainerize. WhatsApp
communication is intended for coaching related matters for those who prefer it. Message response
times may vary. AmiVital coaches do not provide emergency responses and are not available outside
defined hours. Non emergency communication should be reserved for scheduled sessions or standard
channels.
9. Payments and Subscriptions
Payments must be made in full at checkout unless a subscription option is offered. Subscriptions renew
automatically unless cancelled. Clients may cancel subscriptions at any time. Access continues until
the end of the billing cycle. No partial refunds are issued for unused subscription periods.
10. Right of Withdrawal for EU Consumers
EU consumers have a fourteen day withdrawal right for services unless they request immediate service
performance. When purchasing digital products, clients agree to immediate delivery and waive the
fourteen day withdrawal right. For coaching services, requesting immediate start results in a waiver of
withdrawal once the service is fully performed. If withdrawal occurs after partial performance,
proportional payment is required.
11. Refund Policy
Digital products are non refundable. Coaching refunds are handled according to Dutch consumer law
and may involve proportional compensation for services provided. Missed or late cancelled sessions
cannot be refunded or rescheduled. AmiVital may grant exceptions in limited circumstances such as
bereavement.
12. Acceptable Use of Services
Users may not misuse AmiVital services. Misuse includes sharing paid content, harassing staff,
attempting to obtain medical advice, distributing harmful software, interfering with the service, or using
content for commercial purposes. AmiVital reserves the right to deny service for violations.
13. Intellectual Property Rights
All content provided by AmiVital including text, images, training programs, videos, branding, and digital
files is owned by AmiVital. Users receive a limited license for personal use. Users may not reproduce,
modify, distribute, or sell AmiVital content. Unauthorized sharing or commercial use is prohibited.
14. Testimonials and Media
By submitting materials, testimonials, photos, videos, or progress updates, clients grant AmiVital a non
exclusive license to use this content for marketing and educational purposes unless otherwise agreed.
Subtitles or minor edits may be applied without altering meaning.
15. Health and Safety Disclaimer
Fitness and nutrition activities involve risks including injury or illness. Clients are responsible for
ensuring their health readiness. AmiVital recommends completing a physical readiness questionnaire.
Clients must stop any activity that causes discomfort and consult a healthcare provider. AmiVital is not
liable for injuries arising from participation in any activity.
16. Supplements and Future Products
AmiVital may offer supplements such as collagen, protein, and creatine. These products are not
intended to treat or prevent disease. Statements are not evaluated by regulatory authorities. Users
should consult their physicians before using supplements. Users are responsible for reviewing
ingredient lists and allergen information.
17. Data Protection and Privacy
AmiVital processes personal information in accordance with its Privacy Policy and the General Data
Protection Regulation. Data may be transferred or stored outside the European Economic Area with
appropriate safeguards. Users may request data deletion or correction.
18. Limitation of Liability
AmiVital is not liable for indirect, incidental, or consequential damages arising from the use of its
products or services. AmiVital’s liability is limited to the amount paid for the purchased product or
service. Nothing limits liability where such limitation would be unlawful.
19. Governing Law and Jurisdiction
These Terms are governed exclusively by the laws of the Netherlands. All disputes arising from these
Terms shall be resolved solely before the Dutch courts.
20. Amendments
AmiVital may update these Terms without prior notice. Continued use of AmiVital services constitutes
acceptance of updated Terms.
